Two memorable experiences stood out for me – one with my CEO and the other was with my Chief HR Officer. The experience with my CEO occurred during his closing address at one of my company’s leadership development programs. His simple question was “What’s next?” This simple question if reflected and acted upon earnestly, will prevent us from being complacent and drive us to conscientiously think ahead always.

The second experience was a conversation with our CHRO during this year’s HR leadership meeting. When asked what words of wisdom she could offer to guide us into 2011, she said “Always stay close and relevant to the business”, which we all knew was meant to inspire us to continue to add value and be strategic partners to the business.

If I may add, I would say, “Stay close to doing what you love, stay relevant and ahead by developing future capabilities needed to be successful in the near future”.

George Copper, Practice Leader, Workplace Law & Advisory - Asia, Singapore, Freehills
Isabelle I H Wan, Leader of the TransAsia, Employment Law Practice and Co-Leader of Intellectual Property Practice

George Copper and Isabelle Wan will be speaking on the new PRC Employment Contract Law, which will come into effect on 1 January 2008. This law has been widely seen as a ground-breaking piece of legislation that not only revolutionises the rights of employees, but also creates immense hurdles for employers to overcome both during the transition and implementation periods. Since its promulgation, Ms Wan has been assisting her clients to ensure that their HR policies are legally compliant with the requirements of the new law.

The presentations cover the following areas:

  • Hierarchy of labour laws / regulations and the process to create the new law

  • The relationship between the Labour Law and the new Employment Contract Law (ECL) / dispute resolution and statistic

  • Key aspects of the new ECL (explanation of the new provisions, contrast with common law concepts)
    - Written contracts / de-facto employment relationship
    - Fixed term and non-fixed term employment
    - Probation
    - Part-time employment
    - Mandatory consultation and the importance of the Employee Handbook
    - Non-competition

  • Application of the laws to expatriates / perspectives of foreign companies

  • The impact for employers preparing for the changes

Speakers:

George completed his law degree, with Honours, at The University of Melbourne in 1996. He commenced his legal career in the Northern Territory of Australia, completing Articles and was admitted to practice in May 1998.
